Stuart has a mix of litigation and corporate experience, having started practice in a mid-sized firm specialising in construction disputes, and subsequently moving in-house to a Singapore-based multinational company. He now works with Mr Ronald Wong in our mixed practice group which specialises in commercial disputes as well as the provision of corporate legal advice to clients operating in various fields, from construction and engineering to fintech and software development.
He has successfully acted for clients in construction adjudication proceedings, injunction proceedings and commercial disputes, as well as in brokering dispute settlements both as a solicitor and as in-house counsel. His experience on both sides of legal services enables him to take a practical, commercial-minded view of legal issues for the benefit of his clients.
Stuart believes in the provision of quality legal services, having seen the value of this as an in-house legal practitioner on the client side of disputes and negotiations, and works to increase his clients’ understanding of the law by breaking down complex legal issues and communicating them in plain and practical terms. He also remains committed to facilitating access to justice, and volunteers at legal clinics run by Bless Community Services. He also takes on pro bono matters on an ad-hoc basis with the firm from time to time.
Stuart has experience in dealing with construction, contract and commercial disputes, insolvency, and injunction proceedings, as well as general corporate advisory work involving regulatory compliance, contract drafting and reviewing, employment matters and joint venture arrangements.
Sample Cases
Acted in High Court suit against client’s competitor and ex-employees for breach of confidentiality, non-compete and non-solicitation obligations, tort of inducement of breach of contract, vicarious liability, and conspiracy. Successfully obtained an urgent interim injunction against competitor and ex-employees in respect of breach of confidentiality and non-solicitation obligations.
Acted for a landscaping services company in making a claim for unpaid services relating to a construction project under SOPA. Successfully brokered a settlement agreement for payment of the full claim sum.
Acted for the appellant in an appeal in the Appellate Division of the High Court of Singapore where the appellant succeeded in his appeal in part. This is a rare case of a successful claim for the equitable remedy of rectification (and in particular as to the identity of the parties to the contract, which is probably a first in Singapore). On appeal, the court determined and ordered the payment of a reasonable sum for services based on the best available factual evidence.
Acted for warehouse operators in respect of challenging a proposed infringement decision by the Competition and Consumer Commission of Singapore regarding alleged infringement of competition law by way of price-fixing.
Advised fintech company operating a crypto and crypto derivative exchange on software licence agreements, trade mark registration, as well as compliance requirements for operating in Singapore.
Advised fintech startup on the regulatory framework for buy now pay later (BNPL) business and drafting of agreements in connection with the same.
Advising client on potential patent infringement claim against financial institutions regarding a reward transaction system.
Substantially defended S$1.5m construction arbitration claim involving prolongation costs, liquidated damages, allegations of defects as well as arguments on time for completion being set at large.
Successfully negotiating settlement of disputes: including a contested probate action in the Family Justice Courts, a suit in the High Court involving a sum of over S$250,000, and a construction dispute involving a sum of over S$20m.
Successfully acted for clients in defending adjudication applications under the Building and Construction Industry Security of Payment Act for disputes involving claims ranging from S$150,000 to S$2.5m.
Successfully acted for foreign worker on a pro bono basis in defending prosecution initiated by Land Transport Authority in respect of infringements worker was coerced to facilitate in the course of his employment. The Court ordered a discharge amounting to an acquittal in favour of our client.
Successfully conducted a trial in the Magistrate’s Courts for the eviction of an overstaying tenant and recovery of unpaid rent and double rent for the period of overstaying.
Acting for client in High Court proceedings involving approximately S$5m for alleged fraudulently issued invoices. The case involves claims for fraudulent and/or negligent misrepresentation as well as unjust enrichment.
Acting for client in High Court proceedings involving alleged breaches of directors’ duties and dishonest assistance carried out by a corporate third party in connection with alleged diversion of corporate opportunity.
Acting for client in defending clawback proceedings commenced in the High Court by liquidators of a company under the Insolvency, Restructuring and Dissolution Act.
